Seeks To Break Weeks Will.

SEEKS TO BREAK WEEKS WILL.

    Testimony was taken yesterday in the Surrogate's Court in the contest over the probate of the will of Mrs. Lucy Payne Weeks, who died at her home, No. 76 University Place, in 1907, leaving an estate of $100,000. Herbert A. Weeks, a son, and one of the three beneficiaries, is the contestant. He alleged that his mother was of unsound mind at the time of the execution of the will, in April, 1902.
    By the terms of the will the contestant and Charles R. Weeks, his brother, were to receive the old house in University Place. The bequest was subject to a deduction of $7,000, advanced to the latter. It is alleged by the contestant that his brother made certain investments which resulted in the loss of nearly $50,000 of the estate, and assigned all of his claims to Herbert A. Weeks and a half sister, who is co-beneficiary, in an effort to refund the loss. He also resigned as trustee of the estate.
    Dr. G. H. Wynkoop and Dr. Daniel Wynkoop, his son, who attended Mrs. Weeks several times, testified that she was suffering from senile dementia. Dr. O. J. Wilsey, of the Long Island Home, said that he had examined Mrs. Weeks in 1904, and found that she would have been mentally incapable to make a will in 1902. In 1905 the Supreme Court adjudged Mrs. Weeks mentally unsound. The case will continue before Surrogate Thomas.
