Dr. Carnes Henderson Robison

Carnes Henderson Robison was the son of  Robert Robison II and Margaret Henderson.

 

Children of Robert Robison (II) and Margaret Henderson are:

 

Archibald Robison who m. Abigail Barnett

Elizabeth Robison (III) who m. (1) Alexander Gillespie, and (2) Elias Alexander

Polly B. Robison who m. John Knox

[Robert?] Robison (III) who may be the one who m. Isabella Robison

Cynthia H. Robison, never married.

Dr. Carnes Henderson Robison who m. Mary Abigail Alexander

 

 

He married  Mary Abigail Alexander, daughter of William Bain Alexander and Violet Davidson.  Mary Abigail is buried at Hopewell.  Carnes is probably there also, but unmarked.

Considering the uncertainty of my earthly existence, I request that my exr remove the personal property from the place where I now reside to the plantation allotted to me in the division of my father's estate, and at that place sell all my personal property at public auction.  From the proceeds my just debts and funeral expenses are to be paid, and if there is any residue I give it to my SISTER CYNTHIA ROBISON; if the proceeds are not enough to pay my debts, together with the collection of a note for $30 owed to me, then my exr may sell my real estate adj A[rchibald] ROBISON, J. P. Henderson, and Mrs. McClure.  The remainder from the sale of the sd land or the land itself I will to my sister Cynthia.  The interest I have in the JAMES ROBISON* tract adj. Wallace L. Stewart and others I give to my STEP-DAU HETTY ALEXANDER.  My interest in the property of MY WIFE M. A. ROBISON [died on 9 Apr 1845] at the time of our marriage I also give to Hetty.

Assume James Robison mentioned is the one who d. bef 22 Feb 1830.  In his LWT, he mentions his "niece" Eleanor Harris (daughter of Hugh Harris and Martha A. Robison), so I assume Martha A. Ordered by Court that ROBERT SLOAN Administer on the Estate of JAMES ROBISON, SENR, DECD, who came into Court & was duly Qualified & gave bond with JOHN KNOX & NATHAN ORR, Securities, in $1200.

April 27, 1846, Non Cupative [nuncupative] will of Cairns [Kerns] H[enderson] Robison was offered for probate by HETTY ALEXANDER and in part by her next friend JAMES M[cKNITT] ALEXANDER.  It [was] ordered by the Court that notice issue to JOHN KNOX, CYNTHIA [H] ROBISON,  ARCHIBALD ROBISON, Andrew Springs, GUARDIAN [of JOSEPH ROBISON GILLESPIE] & Geo F. Davidson, GUARDIAN [of DORCAS ELIZABETH ALEXANDER], and that publication be made [for] Six weeks in the Charlotte Journal for absentees and that an issue be made up devisavit vel non.

[Non Cupative means the Will was delivered ORALLY to witnesses rather than written: a nuncupative will.  DEVISAVIT VEL NON, practice. The name of an issue sent out of a court of chancery, or one which exercises chancery jurisdiction, to a court of law, chancery, or one which exercises chancery jurisdiction, to a court of law, to try the validity of a paper asserted and denied to be a will, to to try the validity of a paper asserted and denied to be a will, to ascertain whether or not the testator did devise, or whether or not that ascertain whether or not the testator did devise, or whether or not that paper was his will. ]

 

1) Hetty J. Alexander was the step-dau of Carnes (according to his LWT).  Hetty's mother was Mary Abigail Alexander.  It is not clear whether Hetty was born out-of-wedlock, or if Mary Abigail married an Alexander before she married Carnes.

 

2) James McKnitt Alexander was the brother of Mary Abigail Alexander, children of William Bain/Bane Alexander and Violet Davidson.

 

3) John Knox was married to Mary "Polly B" Robison (daughter or Robert Robison II and Margaret Henderson), sister of Carnes H, Cynthia H, Archibald, Robert Robison II, and Elizabeth who married 1) Alexander Gillespie, and 2) Elias Alexander.

 

4) Elizabeth had two children: Joseph Robison Gillespie (by Alexander Gillespie) and Dorcas Elizabeth Alexander by Elias Alexander.

 

5) Carnes Henderson Robison was appointed guardian of Dorcas Elizabeth Alexander in 1843 (see January Session, Book 9, 68).  [?Geo. F. Davidson was "Clerk" appointed as "pendente lite" Guardian of C. H. Robison's minor "heirs"  but not until 1847 (see Jan Session, book 9, 409)

 

6) Andrew Springs was Guardian of Joseph Robison Gillespie.

HETTY ALEXANDER by her next friend J. M. ALEXANDER vs. JOHN KNOX, CYNTHIA & Arnold [sic ARCHIBALD] ALEXANDER, A[ndrew] Springs, GUARDIAN, Geo F. Davidson, GUARDIAN, & OTHERS. Plea - Devisavit vel non.  The following Jury sworn & charged...who find that the paper writing offered is the noncupative will of C. H. Robison [WB I/60]
