Generation One:

Willis Yates and Martha Josey were the parents of Harriet Yates McLeod. Not much is known about Willis Yates, we have been unable to determine his parentage and his relationship to other Yates in the Sumter and Kershaw area.

Willis Yates was born between 1770 and 1780 in either North or South Carolina. The 1850 census in which it is assumed that he was the informant for the household, North Carolina is shown as his birth state. In 1860, Willis had obviously passed away so we can glean no information in that year. In 1880 however, his daughter Harriet Yates McLeod states his place of birth was South Carolina. I have not yet been able to access the 1870 census records of many family members - apparently an entire township or two of Kershaw was not included in ancestry.com's census index.

Martha Josey was born between 1780 and 1790 in North Carolina and died Jul 10, 1875 in Kershaw County. In Martha's case, just as with Willis, we have one census stating South Carolina as the place of birth and another stating North Carolina. As the ancestry of Martha Josey is quite documented by the House of Jossey/Josey, we know that her father appeared in Salem County, Sumter District about 1802 and from her own census records, we know she was married by about 1806. Martha came into South Carolina from North Carolina already a young woman. She was the daughter of William Robert Josey (born Aug 01, 1756 in Nasomond County, Virginia OR North Carolina and died Aug 01, 1832 in Sumter County South Carolina) and Jane Webb (born about 1759 in Kershaw or Sumter South Carolina).

The exact number of children born to Willis and Martha is unknown - census records indicate as many as five children who have yet to be identified. In particular, the 1830 census shows several unidentified females - it appears a possibility that another family is living with the Yates in this year. The 1850 census shows a William Yates aged 44 and a John A. Yates aged 34 living at households 756 and 757 while Martha and Willis are in household 755 - these may be sons of the couple and I have included them here as possibly so.

Future research will include a search for the estate records - it is hoped that those records will help us to identify which of the Yates' found in Sumter and Kershaw Counties of South Carolina are included in our extended family as throughout the years, we find many of our McLeod family marrying into a Yates family - intermarriage between connected families was common in this era and therefore, there is a great likelihood that there is a yet unfound connection.

Was Willis Yeates/Yates the son of Samuel Yates of Sumter District South Carolina (census years 1790-1810)

Searches of the 1790 and 1800 censuses of Kershaw and Sumter have not revealed Willis Yeates/Yates - Willis was born between 1766 and 1784 - in the 1850 Kershaw District Census he stated his place of birth was North Carolina; he also gave his age as 70 which allows us to narrow down that broad birth year range to about 1780.

Using 1780 as his approximate birth year then one can assume he would first be found as a head of household in the 1800 census at approximately the age of 20 yet he is not found in the 1800 Sumter or Kershaw District Census as a head of household in that year.

It would appear from the census research that has been done to date, Willis and Martha Josey married about 1805 with the eldest male child (possibly William) born in 1806. Therefore it could be assumed that Willis was still in his parents household in 1800, moving out and becoming head of his own household in 1810.

This assumes of course, that William migrated into the Sumter area of South Carolina with his parents. Along that line of research, there is indication that he MAY have been the son of a Samuel Yeates/Yates who is found in Claremont County in 1790 and in Salem County, Sumter District in 1800.
In 1810, the first census in which we find Willis and Martha Josey Yates, this Samuel Yates was their next door neighbor. Was Samuel Yates the father of Willis Yates or did Willis Yates come into South Carolina alone, as an adult?

It appears from the index at ancestry.com that Samuel died between 1810 and 1820 as he is not found in that years census of Sumter or Kershaw Districts.

No other Willis or William Yates found in Sumter in this year. The only identifiable child in this census is Harriet Yates - one of the males aged 0-10 might be Jesse Lazarus Yates, however, his birth date is August 13 1820 - was he born by the taking of this census?

It appears from this census, viewed from the perspective of what is known of the family, that there may be an entire second family living in this household in this year. There are a total of 7 females besides Martha Josey Yates in this household - four of these seven females were born between 1810 and 1820 yet in the 1820 census only 2 females are represented as being born in that year range. The females aged 15-20 appear to be too young to have been married and widowed and therefore back in the household - it is possible that at least one of these females could be a wife of the male aged 15-20 but the identity of the second is unknown - there may be grandchildren in this census.

Obituary of Martha Josey Yates

Marriages & Deaths, Baptist Newspapers, SC, 1866-1887

Died, on the 10th of July, 1875, in Kershaw County, near Camden, Mrs. Martha Yates, widow of the late Willis Yates. Her maiden name was Josey, and she was raised in Sumter County, near Bishopville. She united with the Baptist Church nearly forty years ago and was baptized by the Rev. N. Graham. She connected herself with the Antioch Church, Kershaw, in 1846, by letter. Her children say she was about ninety years of age.

Last Will and Testament of Jesse L. Yates (dated 20 September 1870)

In the name of God Amen. I Jesse Lazarus Yates of the State of South Carolina, Sumter County being of sound mind and memory and concerning the uncertainty of this frail and transitory by therefore declare make ordain publish and declare this to be my last Will and Testament. That is to say I commit my Soul to almighty God; who gave it to my body to the ground.

After all my funeral expenses and all my lawful debts are fully paid and discharged, the residue of my Estate, real and personal I give and bequeath to my beloved wife Harriett. I give and bequeath all my Estate real and personal to have and to hold during her natural life, and at her death I give and bequeath to my youngest daughter Soprano, one fourth ………. of my land in no access to be situated and includes my ………and settlement, also all my household and Kitchen furniture. To my other three children I give and bequeath to them the balance of my Estate, share and share alike equally that any of them be living. If they be deceased their share will go to the heirs of their body that may then be living.

In witness hereof I have hereunto subscribed my name and affixed my seal the twentieth day of September in the year of our Lord one Thousand Eight Hundred and Seventy …….and I nominate Thomas McLeod my Executor.

Possible identity of the Witness:

Thomas A McLeod b. about 1836 d. bef. 1880 - This Thomas was the son of John N. and Kitsy Davis McLeod and was the husband of Sarah Victoria Holland. He was the nephew by marriage of Jesse's sister Harriet Yates McLeod.

Obituary of Jesse Lazarus Yates

Died - On the 16th {illegible word}, at his home near Rafting Creek, Mr. J.L. Yates who was born on the 13th of August 1820 near Carter's Crossing in Sumter County.

When a young man, he removed to Kershaw County with his father. He was {married -?} there on December 1847, and located on a farm eight miles east of Camden, where they lived for many years - until his father's death.

The deceased was a soldier in Capt. DePass's artillery company during the late war and served to the end.

He and his wife at the same time were united to the Antioch Church of Christ in September 1864. He was a man of meek and quiet spirit, and discharged the duties of a Christian in faithfullness to God and man. He was a good neighbor, indulgent parent and a loving companion and manifested a friendly and social spirit to mankind.

A few years before his death, he moved to the neighborhood of Rafting Creek, where he lived until his death.

He was a great sufferer in the body for several years before his death, but bore it with great fortitude and Christian resignation.

He leaves a wife and four children, together with many relatives and friends, to mourn their loss, but he died as he had lived - in hope of eternal life. When his wife asked him, just before his departure, what she could do for him, he said "nothing"; but for her and his children to meet him in heaven, where he was going.

His remains were carried to the cemetery of Pisgah Baptist Church, Sumter County on the 17th of September 1880 and there buried in presence of a large assembly of relatives and friends, the burial service being performed by Rev. J. E. Rodgers, past.

Durham was a first cousin of Mary Rosa Ives McLeod, the second wife of Jesse Lazarus McLeod who was the son of Harriet Yates and Alexander McLeod.
